Drum Point Road Right of Ways Drum Point roads are bordered by what is commonly referred to as a “road right of way”. The use of road right of ways is standard practice in road construction and they are provided to allow for maintenance of the road and drainage systems, they are not private property. This means that DPPOA has full right to come onto these road right of ways for road maintenance, make use of the right ways to improve drainage, and occasionally trim tress, shrubs, bushes located in the right of way that become driving hazards. The right of ways in Drum Point are typically 50 ‘ wide (Barreda is 70’ wide) and the roads are not always centered in these right of ways. At the edge of the road right of way is where the private property begins not at the edge of the road surface (when you purchased your property the corner pin should have been marked). It is standard practice for home owners to mow the road right of way and maintain it as part of their yard, which DPPOA appreciates as we cannot afford to offer such a service to satisfy home owners. However, the problems arise when people begin to plant shrubs, tress, etc in the right of way. This type of vegetation inevitably becomes a problem during road maintenance (including even snow removal) and often times damage results to the vegetation. We advise you to not plant things like shrubs, bushes, trees in the road right of ways and definitely not fences. If you do locate such items in the right of way you are fully responsible for the cost removing these items and DPPOA will not reimburse you for their loss; this includes fences. Additionally, if the items you place in the right of way result in an accident, you are liable for any claims that individuals may pursue. Over the years the community has spent thousands of dollars to improve bad drainage areas and even more still need to be addressed. You should not recontour the land as doing so causes drainage problems upstream and downstream of your property. If you damage installed road drainage by recontouring the land, you will be charged to rectify the problem. |
