First Special Tax District 1997-1999

Drum Point is a commonly owned community originally consisting of approximately 1800 platted lots. The privileges afforded to the property owners of Drum Point include a road and causeway system, beach, boat ramp, and inland lakes. The majority of the costs to property owners is the maintenance of the causeways and road system. Prior to 1996 the money for these costs was collected under a diverse covenant structure that existed among the property owners in Drum Point. Approximately 1100 lots were governed by Drum Point covenants with an annual covenant road fee of $10/yr and approximately 625 lots were governed by Chesapeake Ranch Club Estate (CRE) covenants with an annual road fee of approximately $105/yr. In early 1996 the holders of CRE covenants voted to replace their CRE covenants with Drum Point covenants. This common covenant is on file in the Calvert County Homeowners Depository in the land records office. Therefore, all platted lots in Drum Point became subject to the same set of Drum Point covenants and the obligatory road fee for all lots became $10/year. Concurrent with this effort the Drum Point Property Owners Association petitioned the Calvert County Commissioners to declare a Special Tax District in Drum Point.

The Maryland Annotated Code, Section 4-101 through 4-104, the Public Local Laws of Calvert County Laws, Title 4 Special Taxing Districts stipulates that a Home Owners Association, as defined under Maryland Home Owners Association Statutes, may petition the Calvert County Commissioners to establish a Special Tax District to fund the cost of furnishing, providing, and maintaining community roads, drainage, lakes, canals, community wide amenities, and benefits. The Drum Point Property Owners Association (DPPOA), a Home Owners Association as defined under the appropriate Maryland statutes, petitioned the Calvert County Commissioners in January of 1996 to establish a special tax district (STD) that would assess each lot in the Drum Point subdivision $162 per year for the duration of four years to support a community improvement program (after county administrative expenses were added the total came to $163.62 per year).

 Prior to the petition submittal, DPPOA sponsored a focus group to determine the priorities of the community and what the community was willing to spend to achieve these priorities. A four year program was developed based on the focus group findings and public meetings sponsored by DPPOA were held at the Southern Community Center on November 21, 1995 and December 13, 1995. At these meetings a detailed explanation of the State Legislation for Tax Districts and a four year improvement plan was presented. A motion was approved at the December 13, 1996 meeting to petition the Calvert County Board of Commissioners to create a Special Tax District for the discussed four year program. A summary of the petition was published in the March 1996 DPPOA Newsletter (sent to all property owners) and Calvert County gave a 30 day notice of the final public hearing to all Drum Point property owners via direct mail. On April 23, 1996 the county sponsored public hearing was held at the Southern Community Center and on June 18, 1996 the Calvert County Board of Commissioners approved the Drum Point Special Taxing District.
